As Chair of the Corporate Compliance & Internal Investigations Practice, Ben specializes in corporate compliance, internal investigations, and litigation on behalf of clients who do business with the government. A Member based in the firm’s Boston office, he represents government contractors across multiple jurisdictions and industries, from the global construction materials markets of concrete and cement, to the manufacturing, health care, and life sciences sectors. He is also co-founder of the firm’s Global Construction Materials practice.

The breadth of Ben’s litigation experience also extends to white collar criminal defense, complex commercial litigation, and real estate and land use disputes. His litigation track record exemplifies Mintz Levin’s belief that “the best win is an early win.” In just the last several years he has won at least 15 cases for his clients on motions to dismiss or motions for summary judgment, before the cases ever reached trial. And when his cases do go to trial, his record is just as impressive: he has tried or co-tried seven cases, and won all seven. Ben regularly practices before state and federal appellate courts as well, defending the victories won at the trial court level. In his real estate and land use practice alone, he has appeared a dozen times in the last several years before the Massachusetts Appeals Court or the Massachusetts Supreme Judicial Court, where, among other victories, he has successfully defended numerous land use permits from appellants’ challenges.

He is a leading attorney in Mintz Levin’s representation of clients facing high-profile government investigations, including the investigation of the “Big Dig” project in Boston, and has defended companies and individuals against investigations by the Department of Justice, Securities and Exchange Commission, Federal Highway Administration, Environmental Protection Agency, Massachusetts Attorney General's Office, U.S. Attorney's Office in Massachusetts, and other state and federal agencies.

Ben has a long record of public service. Prior to joining the firm, he worked in the Massachusetts Legislature and at the Massachusetts Department of Labor and Workforce Development, where he was manager of the Commonwealth's prevailing wage and occupational safety programs. In addition, before law school, Ben served as an active duty officer in the U.S. Army, followed by several years in the Army National Guard and Reserves. He also has served in various elected and appointed positions in the local government of his hometown.

Ben received his B.A. from Boston University and his J.D., cum laude, from Suffolk University Law School, where he won several awards for outstanding legal writing and oral advocacy, and served as an editor of the Suffolk University Law Review. He is the author or co-author of many published articles and legal works, especially in the area of corporate and regulatory compliance for government contractors.

Ben is a member of the American Concrete Institute and the National Ready-Mixed Concrete Association. He has also served as a member of the Massachusetts Bar Association’s Civil Litigation and Property Law section councils, appointive bodies of bar leaders in those fields of law. And he serves on the board of directors of the Lawyers Clearinghouse (promoting affordable housing, homelessness services, and community development).

Ben is a member of the Massachusetts bar, as well as the bars of the U.S. Court of Appeals for the First Circuit and the Supreme Court of the United States.
