Accreditation, Licensing and Certification

Health care providers operate under a broad umbrella of accreditation, licensing, and certification requirements imposed by federal, state, and even local authorities. Mintz Levin’s health law attorneys regularly represent the full spectrum of health care providers—including hospitals, clinics, skilled nursing facilities, pharmacies, laboratories, and individual or group physician practices—in obtaining and renewing the approvals they need to provide services. We also help clients challenge the proposed revocation, suspension, or restriction of these approvals.

Accreditation, licensing, and certification come into play in many contexts, including capital development and facility construction, mergers and acquisitions, implementation of new technologies or innovative services, and fundamental operational and professional practice issues.

Our experience in this area includes:

  • obtaining regulatory approvals for a variety of clients, including a hospital building a new medical-surgical wing and a cancer center (jointly developed by a hospital, physician practice, and clinic) that will provide radiation oncology, chemotherapy, and related services
  • working with Massachusetts regulatory leaders to formulate state regulations for limited services clinics, and successfully facilitating the opening of the first limited services clinics in Massachusetts
  • advising clients, including independent laboratories and home health providers, on accreditation, licensing, and certification issues arising in connection with mergers and acquisitions
  • representing a dialysis company in successfully obtaining certificates of need for the development of a new dialysis center and the expansion of two existing facilities in the District of Columbia.
