Intellectual Property

Mintz Levin has a fully integrated intellectual property practice, with more than 90 attorneys, scientists and other professionals focused on the protection, licensing and enforcement of intellectual property rights across all of its offices – Boston, London, New York, Palo Alto, San Diego and Washington, DC.

We assist clients both domestically and internationally with the many significant issues and challenges involved in this critical area, with a breadth and depth of experience that puts Mintz Levin's intellectual property group at the forefront of the field. We provide comprehensive, practical advice to a wide range of emerging and established technology-based businesses in high technology, biotechnology, life sciences, medical devices, manufacturing, nanotechnology, and telecommunications, as well as other industries. Our diverse client base includes multinational corporations, universities, early-stage companies, and individual inventors. The intellectual property group works closely with our business lawyers and litigators, and, like all practice groups at Mintz Levin, is committed to providing clients with dedicated service and the best advice.

The full range of the firm's intellectual property services include:

  • patent litigation;
  • patent and trademark prosecution;
  • due diligence and licensing for business transactions;
  •  licensing;
  • consistent international patent advisory methodology;
  • obtaining, licensing and enforcing intellectual property rights;
  • devising strategies for implementing the protection of intellectual property;
  • working with clients to establish Intellectual Property programs enterprise-wide;
  • conducting initial and ongoing Intellectual Property audits;
  • providing guidance to avoid infringing on the intellectual property rights of others;
  • opinion work, and
  • alternative dispute resolution.

We represent clients before the U.S. Patent and Trademark Office, the U.S. Copyright Office, in federal and state courts, as well as the European Patent Office and before regulatory and administrative agencies. The practice also includes representation and counseling in the areas of trade secrets and unfair competition, including trial and appellate litigation.

We have been actively involved--through counseling, litigation, and legislative representation--in copyright issues in emerging content technologies, including online, Internet, cable, and digital publications and transmission of content.

Our Intellectual Property practice is fully integrated with other firm disciplines--Corporate, Litigation, Federal Regulation--and is well-positioned to leverage inter-practice synergies in order to provide clients with "one-stop" representation. We are able to offer cost-effective and strategically practical legal advice based not only on extensive intellectual property knowledge but also on broad transactional and litigation experience.
